Digital Millennium Copyright Act (DMCA) Policy

1. Introduction

Funky Husky Inc., a Florida corporation with offices in California ("MuscleBulls,""we,""us," or"our"), respects intellectual property rights. This DMCA Policy explains how we comply with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) and how copyright owners can report infringement.

We take copyright infringement seriously. When we receive valid DMCA notices, we'll remove or disable access to the allegedly infringing content and may terminate repeat infringers' accounts.

3. Notification of Claimed Infringement (DMCA Takedown Notice)

3.1 Requirements for a Valid DMCA Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on or accessible through the Services infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our Copyright Agent with the following information in writing:

Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. An electronic signature may be a scanned copy of a handwritten signature or a typed name preceded by"/s/".
Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. Please provide sufficient detail to allow us to identify the work(s), such as title, author, registration number (if registered), or any other distinguishing characteristics.
Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material. Please provide specific URLs or other identifying information that will enable us to locate the allegedly infringing material on the Services.
Your Contact Information: Information reasonably sufficient to permit us to contact you, such as your full legal name, mailing address, telephone number, and email address. We may need to contact you for clarification or to provide notice of our actions.
Good Faith Belief Statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. This statement should be worded as follows:"I have a good faith belief that the use of the copyrighted material described above is not authorized by the copyright owner, its agent, or the law."
Accuracy and Authorization Statement: A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This statement should be worded as follows:"I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner, or am authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed."

3.2 Failure to Include Required Information

Please note that under 17 U.S.C. § 512(c)(3), a DMCA notice may not be effective if it does not include substantially all of the above information. Incomplete notices may not be acted upon. Furthermore, providing false, misleading, or inaccurate information in a DMCA notice may result in civil liability for damages, costs, and attorneys' fees under 17 U.S.C. § 512(f).

3.3 Response to DMCA Notices

Upon receipt of a valid DMCA notice that complies with the requirements set forth above, we will:

Expeditiously remove or disable access to the material that is claimed to be infringing or to be the subject of infringing activity;
Notify the user who posted the material that we have removed or disabled access to the material; and
Provide the user with a copy of the DMCA notice, including the contact information of the complaining party, unless the complaining party requests anonymity in accordance with applicable law.

We reserve the right to remove or disable access to allegedly infringing material without prior notice at our sole discretion. We are not obligated to provide the alleged infringer with advance notice before removing or disabling access to allegedly infringing material.

4. Counter-Notification

4.1 Requirements for a Valid Counter-Notification

If you believe that material you posted on the Services was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent by providing the following information in writing:

Physical or Electronic Signature: Your physical or electronic signature. An electronic signature may be a scanned copy of a handwritten signature or a typed name preceded by"/s/".
Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled. Please provide the specific URL(s) or other identifying information for the material.
Good Faith Belief Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled. This statement should be worded as follows:"I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled."
Your Contact Information: Your name, address, telephone number, and email address.
Consent to Jurisdiction and Service of Process: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the Company may be found (which includes the State of Florida), and that you will accept service of process from the person who provided the DMCA notice or an agent of such person.

4.2 Response to Counter-Notifications

Upon receipt of a valid counter-notification that complies with the requirements set forth above, we will:

Promptly provide the person who provided the original DMCA notice with a copy of the counter-notification;
Inform that person that we will replace the removed material or cease disabling access to it in ten (10) business days unless our Copyright Agent first receives notice from the person who submitted the DMCA notice that such person has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on the Services; and
Replace the removed material or cease disabling access to it not less than ten (10) and not more than fourteen (14) business days following receipt of the counter-notification, unless our Copyright Agent receives notice that the original complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on the Services.

4.3 Warning Regarding False Counter-Notifications

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be subject to liability for damages, costs, and attorneys' fees. Do not make false claims. If you are unsure whether the material was removed or disabled by mistake or misidentification, consult with an attorney before filing a counter-notification.

5. Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Services and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

A"repeat infringer" includes, but is not limited to, any user who has been notified of infringing activity more than twice and/or has had material removed from the Services more than twice. The determination of whether a user is a repeat infringer is at our sole discretion and may take into account the totality of the circumstances, including the nature and severity of the infringement, the number of infringements, and any other relevant factors.

6. Misrepresentation and Liability

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that:

Material or activity is infringing (in a DMCA notice); or
Material or activity was removed or disabled by mistake or misidentification (in a counter-notification);

shall be liable for any damages, including costs and attorneys' fees, incurred by the alleged infringer, the copyright owner or copyright owner's authorized licensee, or the service provider, who is injured by such misrepresentation, as the result of the service provider relying upon such misrepresentation in removing or disabling access to the material or activity claimed to be infringing, or in replacing the removed material or ceasing to disable access to it.

We reserve the right to seek damages and attorneys' fees from any party who submits a notification or counter-notification in bad faith or with knowledge of material misrepresentation. Before submitting a DMCA notice or counter-notification, please carefully consider whether you have a legitimate claim and consult with legal counsel if you are uncertain.

7. Other Intellectual Property Rights

While this policy focuses on copyright, we also respect trademarks, patents, and trade secrets. If you believe content on our Services infringes your other intellectual property rights, contact us at info@musclebulls.com or via our contact form with details. We'll review each claim individually.

8. Processing Time and Response

We endeavor to process all valid DMCA notices and counter-notifications promptly and in accordance with the timelines specified by the DMCA. However, the volume of notices we receive may affect processing times. While we cannot guarantee an immediate response, we will make every reasonable effort to respond to valid notices within a reasonable time period. Please allow up to five (5) business days for an initial response to your notice.

Your continued use of the Services following the posting of changes to this DMCA Policy means that you accept those changes.
